Terms of Service

These are the terms of the agreement between you and Xspark LLP for the use of Twoly. By creating an account you accept them. If you don't accept them, don't create one — and if you've already created one, delete it and you owe us nothing.

We've tried to write these in normal sentences. Where a clause exists because a court or an app store requires it, we've said so, so you can tell the difference between a rule that protects you and a rule that protects us.

"We", "us" and "our" mean Xspark LLP. "Twoly" or "the app" means the Twoly mobile application, its widgets, and https://trytwoly.com. "You" means you.

2. What Twoly is

Twoly lets you share what you're up to with a small number of people you choose, and see the same from them, on your home screen. That's the whole service.

Twoly is not an emergency service, a safety service, a location-tracking service, or a way to monitor anyone. It is not designed for, and must not be relied on for, anyone's safety. If someone is in danger, call the emergency services — Twoly may be delayed, wrong, or offline, and none of its data is guaranteed to be current.

3. Who can use it

You must be 18 years of age or older to use Twoly. By creating an account you confirm that you are.

You also confirm that you are not barred from using the service under any applicable law, and that you are creating an account for yourself and not on anyone else's behalf.

We may close an account we reasonably believe belongs to someone under 18. See the Privacy Policy §9 for why the line is at 18.

6. Your content, and what we may do with it

You own what you write. Your name, notes, moods, status, vow and signature remain yours. We claim no ownership of any of it.

You grant us a limited, non-exclusive, royalty-free licence to store, transmit, format and display your content solely to operate Twoly for you and the people you're connected to. That licence exists so we're allowed to put your note on your partner's screen; it does not let us publish it, sell it, train on it, or show it to anyone else. It ends when you delete your content or your account.

We do not use your content to train machine-learning models.

6.1 Content about other people

Twoly lets you enter a partner's name, appearance and your anniversary before they've joined, and lets you write notes and vows that mention people. You are responsible for what you enter about someone else. Only enter what you'd be comfortable with them reading — because when they join, they can. If someone asks us to remove their details that you entered, we will act on it.

8. Twoly Pro (subscriptions)

8.1 What it is

Twoly's core is free and stays free, because the app only works if both people have it. Twoly Pro adds depth on top: everyone on your widget rather than one person, unlimited emoji sends, every mascot look, and your full history.

8.2 Prices, and who charges you

Subscriptions are sold in India from ₹59/week, ₹149/month, or ₹899/year, and in the US from $2.49/week, $4.99/month, or $29.99/year. The yearly plan includes a 7-day free trial. Current prices are always shown in the app before you buy, and the store shows you the final price in your own currency before you confirm.

We do not take your payment. Every purchase goes through the Apple App Store or Google Play, as those platforms' rules require. They are the ones who charge you, and your purchase is also subject to their terms. We never receive your card, UPI or bank details.

8.3 Renewal, and how to stop it

Subscriptions renew automatically at the end of each period, at the then-current price, until you cancel. Cancel at least 24 hours before the period ends to avoid the next charge.

You cancel through the store, not through us — we have no ability to cancel a subscription on your behalf:

If you started a free trial and cancel before it ends, you are not charged. If you don't cancel, the trial converts to a paid subscription automatically.

Cancelling stops future charges. It does not refund past ones — see the Refund Policy.

8.4 Price changes

We may change prices. If a change affects your existing subscription, you'll be told in advance by us and by the store, and the store will ask for your consent before charging you more. A price change never applies retroactively to a period you've already paid for.

8.5 If a feature goes away

If we remove a Pro feature you're paying for and don't replace it with something comparable, email us — we'll sort out a fair refund of the unused part of your term.

9. Availability, and changes to the app

We'll try to keep Twoly running and working. We can't promise it will never be down, slow, or briefly wrong — no service can.

We may add, change or remove features. If we remove something that materially changes what the app is for you, we'll tell you in the app first.

We may suspend or stop the service entirely. If we ever shut Twoly down, we will give you at least 30 days' notice, refund any unused prepaid subscription time, and give you a way to export what you wrote.

10. Ending this agreement

You can leave at any time. Delete your account in Settings or from the web. No exit interview, no retention offer, no dark pattern.

We can end it if you break these terms or the Community Guidelines, if we're legally required to, or if your use puts other users or the service at risk. Except where the breach is serious — abuse, illegal content, or a security attack, where we may act immediately — we will tell you what the problem is and give you a chance to respond first.

If we terminate your account without cause, we'll refund unused prepaid time.

11. Third parties

Twoly relies on Apple, Google, Supabase, RevenueCat and Expo to function (Privacy Policy §4.2). We're responsible for our own service; we are not responsible for their outages, their terms, or their decisions about your device or your payment. Nothing in these terms creates any obligation for Apple or Google toward you, and neither of them is a party to this agreement.

12. Our liability

Please read this section — it's the one that limits what you can recover from us.

Twoly is provided "as is". To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, loss of data, or loss of goodwill.

Our total liability to you for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) ₹5,000. If you've never paid us anything, that cap is ₹5,000, and we'd rather say that plainly than bury it.

Nothing in this section limits liability that cannot lawfully be limited — including liability for fraud, for death or personal injury caused by negligence, or any right you have as a consumer under the Consumer Protection Act, 2019 that cannot be contracted away. If you are a consumer, these terms do not take away your statutory rights.

13. You cover us for your own misuse

If someone brings a claim against us because of something you did that broke these terms — content you posted, or someone else's data you entered — you agree to cover our reasonable costs in dealing with it. This does not apply where the claim arises from something we did.

14. Grievances and disputes

Start here, not in court. Our Grievance Officer is named at Grievance Redressal. We acknowledge complaints within 24 hours and aim to resolve them within 15 days, as India's IT Rules require. Most things end here.
